Terms of Service
Please carefully read VietHosting's Terms of Service (ToS). These terms govern your use of our services; agreement is required for registration & continued use.
1. Acceptance of Terms of Service
This Terms of Service agreement (hereinafter referred to as "ToS") outlines the legally binding terms and conditions between VietHosting ("We", "Us", "Our", "Company") and you, the customer ("Customer", "You"), concerning the registration and use of all services provided by VietHosting.
- By completing the registration process or using any of our services, You confirm that you have carefully read, fully understood, and agree to be bound by the entirety of this ToS.
2. Service Management Account
To use our services, Customers are required to create an account on VietHosting's client management system at https://clients.viethosting.com.
- Customers commit to providing accurate, complete, and up-to-date account registration information, including but not limited to: full name, address, email, phone number, personal identification information (National ID/Citizen ID/Passport number) or business information (company name, tax code/business registration number) as required. This account enables Customers to manage their active service packages, track invoices, process renewal payments, submit technical support requests, and utilize other service-related functions.
- Customers are solely responsible for maintaining the absolute confidentiality of their account login credentials (username and password) and are fully liable before the law and VietHosting for all activities and transactions conducted through their account. Customers must immediately notify VietHosting upon detecting any unauthorized access or security breach related to their account.
3. Payment and Service Renewal
- Customers may select a payment method from the options accepted by VietHosting and published on our Payment Methods page. Services will only be activated or renewed after VietHosting has received the full payment and confirmed a successful transaction.
- All services are provided on a prepaid basis to ensure continuity. For new service registrations, Customers must complete payment within 48 hours from the invoice creation time. After this period, if payment is not received, VietHosting reserves the right to cancel the order without prior notice.
- For service renewals, our system will automatically generate an invoice and send a notification to the Customer's registered email address 10 days before the expiration date. To avoid service interruption, Customers are advised to make renewal payments proactively, preferably 7 to 10 days before the expiration date.
- VietHosting reserves the right to refuse payment transactions if there is reasonable suspicion of non-transparency, fraudulent activity, or potentially illegal operations.
- If Customers use PayPal for payment, they acknowledge that PayPal may support automatic renewal features (subscription/pre-approved payment). If a Customer decides to cancel their service with VietHosting, they are solely responsible for ensuring that the corresponding automatic payment function from VietHosting is disabled within their PayPal account. This is to prevent automatic charges for subsequent billing cycles, even if the invoice from VietHosting has been canceled. This functionality is managed by PayPal and is beyond VietHosting's control; we will not be responsible for resolving such cases.
- Customers are responsible for timely service renewal payments. Services will be automatically suspended upon reaching the expiration date if payment has not been made. If VietHosting does not receive renewal payment within 7 days after the expiration date, data related to that service may be permanently deleted and will be irrecoverable.
- Value Added Tax (VAT) is a mandatory levy as stipulated by Vietnamese law. VietHosting is responsible for collecting VAT from Customers and remitting it to the tax authorities. All service prices listed on the https://viethosting.com website do not include VAT, unless otherwise specifically noted.
4. Service Cancellation and Suspension Policy
- Customers have the right to request the cancellation of any service they are using. Cancellation requests must be formally submitted through VietHosting's client management system at https://clients.viethosting.com.
- Upon service cancellation, all Customer data and related services at VietHosting will be permanently deleted. Any remaining prepaid service fees (if eligible) will be considered for processing according to our Refund Policy, as published at Refund Policy.
- Customers wishing to terminate a service after the current billing cycle ends and do not want to receive a renewal invoice for the next term must submit a cancellation request with the 'End of Billing Cycle' option at least 07 days before the service's expiration date.
- VietHosting reserves the right to suspend services immediately (potentially without prior notice in urgent cases) if the Customer violates any laws, seriously breaches the terms of this ToS, or engages in system resource abuse that affects the stability of the service or other customers. The duration of the suspension will depend on the nature and severity of the violation. VietHosting is not liable for any damages to the Customer's business operations or any data loss resulting from service suspension due to the Customer's fault.
- VietHosting also reserves the right to suspend services if the Customer fails to complete service fee payments by the due date. Services will be restored after the Customer has fulfilled all outstanding payment obligations.
5. Customer Support
VietHosting provides customer support through official channels including phone, WhatsApp, and Zalo for general inquiries or quick consultations.
For support requests concerning security-sensitive matters (such as login credentials, service passwords) or complex technical issues that require extended processing time, detailed tracking, and record-keeping, Customers are required to submit a support ticket via the client management system at https://clients.viethosting.com or send an email to support@viethosting.com to ensure security and efficiency.
6. Customer Responsibilities
- Customers are obliged to maintain the security of their service account information, client management system login credentials, and other sensitive information. Customers must immediately notify VietHosting upon detecting any unauthorized access to their account or any security vulnerabilities, including the loss, theft, or disclosure of passwords and other critical information.
- Customers are solely responsible before the law for the content of their websites and all data stored on VietHosting's servers. Customers must comply with the laws of Vietnam and applicable international conventions to which Vietnam is a signatory regarding the use of Internet services, protection of state secrets, national security, culture, intellectual property rights, and software copyrights (including operating systems and applications installed on the server, if any).
- Customers are primarily responsible for maintaining and backing up their data and source code on VietHosting's servers. Unless a separate backup service agreement is in place, VietHosting will not be liable for data loss due to accidental deletion by the Customer, user error, or security procedures implemented by the Customer.
- Customers must ensure that their websites and applications on our servers are used for lawful purposes only and do not violate any provisions of this ToS.
- Customers are responsible for providing accurate and truthful information of the individual or organization when registering for services. When requested, Customers must ensure that all personal or legal identification documents (such as ID cards, passports, business licenses) provided to us are valid and accurate.
- Customers using our services should provide honest, objective, and fact-based feedback on service quality across all media, websites, and forums. All feedback must be accompanied by verifiable evidence. VietHosting reserves the right to unilaterally terminate the service agreement if feedback is found to be inaccurate, false, offensive, defamatory, or negatively impacting the Company's reputation.
- In the event of any changes related to service registration information (e.g., username, contact details, payment information, domain name used for hosting), Customers are responsible for promptly notifying VietHosting via email or by submitting a support ticket through the Client Management System.
7. Resource & Bandwidth Policy
- Network bandwidth provided by VietHosting is allocated based on specific usage models and configuration options to ensure overall system stability, fairness, and security.
- Shared bandwidth may operate on a burstable basis, allowing temporary increases when network resources are available. Advertised bandwidth values under this model represent maximum limits and do not constitute continuous or guaranteed throughput for individual services.
- If sustained bandwidth usage exceeding the allowed limits is detected and is deemed to impact the infrastructure or other services, VietHosting reserves the right to apply traffic shaping mechanisms. In such cases, bandwidth may be restricted to a minimum level of 10 Mbps.
- This limitation will be lifted and bandwidth restored to its original configuration once usage returns to acceptable levels, no longer affects the shared system, or after the customer has implemented appropriate corrective measures as advised by VietHosting.
- Private (Dedicated) or policy-based bandwidth is provisioned with independent policy groups, applied exclusively to the associated service, allowing greater control and more consistent performance compared to shared bandwidth.
- VietHosting does not guarantee continuous bandwidth throughput unless explicitly agreed upon in writing. Actual performance may vary depending on the bandwidth model, network conditions, and overall system load.
8. VietHosting's Responsibilities
9. Prohibited Uses of Service
VietHosting reserves the right to immediately suspend services without applying a refund policy, or refuse future service, if the Customer violates any of the usage regulations outlined in the "Prohibited Uses of Service" section below:
- Services must not be used for any activities that violate the current laws of the Socialist Republic of Vietnam and applicable international conventions to which Vietnam is a signatory.
- Services must not be used to store or disseminate content that opposes the Socialist Republic of Vietnam; incites violence, religious, ethnic, or political conflicts; distributes pornographic or obscene materials; or any other content contrary to Vietnamese customs and traditions.
- Server services or server resources must not be used to distribute spam email, unsolicited commercial email, or engage in large-scale email campaigns that negatively affect the reputation of VietHosting's IP address ranges.
- Customers using VPS or Dedicated Server services must adhere to the regulations and recommendations of reputable anti-spam organizations such as Spamhaus to prevent VietHosting's IP addresses from being blacklisted. Any Customer action leading to VietHosting-provided IP ranges being blacklisted by Spamhaus, Barracuda, etc., will result in service suspension and potential termination without a refund for the remaining service period. - Prohibition of Reverse DNS (rDNS) Abuse: To protect the reputation of our IP address ranges, Customers using VPS and Dedicated Server services are permitted to request an rDNS change a maximum of one (1) time per month. Frequent rDNS changes can be considered abusive behavior for malicious purposes (such as email spamming), which harms the reputation of the IP address range. If a Customer's request violates this limit, VietHosting reserves the right to decline the request until the stipulated time frame has been met.
- The distribution and storage of malicious code (malware), viruses, trojans, worms, attack tools (such as Botnets, DDoS scripts), or phishing websites for the purpose of attacking other websites or disrupting VietHosting's systems or other systems on the Internet is strictly prohibited. This includes instances where the Customer's website contains malicious code due to being compromised or is the target of large-scale DDoS attacks severely impacting the shared system.
- Server services must not be used to host websites that impersonate other individuals or organizations, thereby damaging their honor, dignity, or reputation.
- The use of software or scripts that abuse system resources such as bandwidth, CPU, RAM, I/O (e.g., Coin Mining software, automated website traffic exchange tools) is strictly prohibited.
- Websites must not be used to promote illegal services or products as stipulated in Decree 15/2020/NĐ-CP of the Vietnamese Government and other relevant legal documents.
- Services must not be used to store or share digital content that infringes upon the copyright or intellectual property rights of third parties, or content that impersonates other organizations/individuals without authorization.
10. Limitation of Liability and Compensation
- VietHosting's liability is limited to the scope defined within this document, unless otherwise agreed in writing between both parties. The Customer is not entitled to waive their responsibilities and obligations under the terms accepted herein.
- In the event that VietHosting fails to provide the committed service quality (e.g., uptime below the guaranteed level), compensation (if applicable) will be provided to the Customer in the form of additional service usage time or a partial refund corresponding to the period of service unavailability.
- The specific compensation value will be determined by VietHosting on a case-by-case basis and does not include any indirect losses, loss of profit, or other consequential damages incurred by the Customer due to service interruption.
11. Data Security and Customer Information Confidentiality
- VietHosting commits not to access Customer data stored on servers without explicit consent from the Customer, except in cases mandated by competent legal authorities or to address urgent technical issues to ensure system security and stability.
- VietHosting proactively implements necessary technical measures and management procedures to ensure the security of Customer data within our capabilities and responsibilities, depending on the specific commitments of each service type.
- However, VietHosting shall not be legally liable for data loss or leakage due to objective incidents beyond our control, such as natural disasters, fires, accidents, earthquakes, floods, embargoes, wars, acts of competent state authorities, or any other force majeure events that are unforeseeable and unavoidable, as well as subjective causes on the part of the Customer (e.g., security configuration errors, vulnerabilities in the Customer's website).
12. Changes to Terms of Service
- VietHosting reserves the right to amend, supplement, or update these Terms of Service at any time without prior notice.
- Changes will take effect immediately upon being publicly posted on VietHosting's official website. Customers are responsible for regularly monitoring and reviewing the latest version of the Terms of Service at: https://viethosting.com/en/terms-of-service/.
- The Customer's continued use of services after changes are published constitutes acceptance of and agreement to be bound by the amended or supplemented terms.
